Anti-Counterfeiting and Intellectual Property Policy
1. All existing Intellectual Property Rights of Z2U, its contractors, partners, services providers, suppliers, or licensors (if any) shall belong and remain with its respective owner. Nothing in this Agreement shall transfer or assign such Intellectual Property Rights to you.
2. All Intellectual Property Rights created and/or developed pursuant to this Agreement by Z2U (its suppliers, contractors, partners and/or licensors (if any)) shall belong absolutely to Z2U.
3. Z2U is a marketplace for digital goods and services. Z2U enforces a zero-tolerance policy and does not permit the listing, sale, purchase, delivery, or promotion of counterfeit, pirated, stolen, fraudulently obtained, unlawfully obtained, or unauthorized goods or services. You shall not, whether by yourself or through any other person, engage in any conduct which will infringe the Intellectual Property Rights of Z2U or those of any third party in relation to your use of the Platform and/or the Z2U Services.
4. Sellers are strictly prohibited from listing or selling:
(a) Counterfeit goods or services that imitate, replicate, or misuse trademarks, brands, copyrighted works, product names, logos, game titles, characters, or other intellectual property without legitimate authorization;
(b) Pirated, cracked, cloned, duplicated, generated, leaked, stolen, or fraudulently obtained software, licenses, activation keys, gift cards, vouchers, digital codes, accounts, subscriptions, or in-game assets;
(c) Gaming, streaming, social media, e-commerce, financial, or other third-party platform accounts that are compromised, registered with false information, obtained without authorization, advertised with misleading identity or verification claims (including but not limited to claims of "fully verified", "has order history", or "comes with original email"), or otherwise violate applicable laws, third-party terms of service, or platform rules;
(d) Products or services that misrepresent their source, authenticity, validity period, region, delivery method, ownership, warranty, or usage rights;
(e) Any product, service, content, listing, message, or transaction that infringes or may infringe any third-party intellectual property right, contractual right, consumer protection law, payment network rule, or applicable law.
5. You shall use any Information and/or properties made available to you by Z2U under this Agreement in which any of Z2U's Intellectual Property Rights subsist solely for the purpose of and only to the extent permitted by this Agreement.This Clause shall survive the termination of this Agreement. All rights (including intellectual property rights), title, ownership in and to the games are owned exclusively by respective game developers. Reference to any products, services, processes or other information by name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship, or recommendation by the Platform.
6. Sellers are solely responsible for obtaining, ensuring, and verifying that they have all necessary rights, licenses, permissions, consents, and authorizations to list, sell, deliver, and support their goods or services. Sellers must provide verifiable supporting documents immediately upon Z2U's request, including but not limited to: proof of source, supplier records, purchase invoices/records, letters of authorization, license documents, proof of delivery (PoD), or other necessary compliance materials.
7. Z2U may proactively review, restrict, suspend, remove, or delist any listing, transaction, or account that is suspected of violating this policy. Upon detecting or receiving verified reports of counterfeit, infringing, or non-compliant products, Z2U reserves the absolute right to take the following enforcement measures without prior notice:
(a) Cancel related orders, issue refunds to buyers, and reject or remove any non-compliant listings;
(b) Apply rolling reserves, suspend withdrawal privileges, and deduct penalties, chargeback fees, or actual losses from the seller's account;
(c) Freeze the merchant's wallet balances and withhold payouts since order completion for up to 180 days to cover potential chargebacks, arbitration fees, or legal liabilities;
(d) Permanently terminate the violating account. Repeated, intentional, fraudulent, or severe violations will result in immediate permanent termination and absolute forfeiture or withholding of seller balances to cover refunds, chargebacks, fines, administrative penalties, investigation costs, legal fees, and any other associated liabilities. Z2U cooperates fully with law enforcement agencies, payment partners, regulators, and brand owners to pursue direct legal recourse against severe violators.
8. Rights holders, brand representatives, or authorized agents may submit trademark/copyright infringement notices, ownership evidence, and takedown requests directly to our dedicated compliance email at legal@z2u.com, or via the platform's designated procedure found at https://www.Z2U.com/dmca. Z2U will review such notices and may request additional information before taking action. Sellers may be given an opportunity to respond via a counter-notice where appropriate, unless immediate action is required to prevent imminent legal, financial, consumer fraud, or platform systemic risk.
